Activity waiver

ACTIVITY WAIVER, ASSUMPTION OF RISK, AND RELEASE This waiver is between you (the Joiner) and the organizer named on the Pheaks listing you are booking (the Organizer). Pheaks (PH + peaks), operated by Jefferyl Castillo, is a booking platform. It is not the trip operator, guide, landowner, or transport provider. By ticking the box at checkout, or by being added as a walk-in, you confirm that you have read this waiver, understand it, and agree to it. If you are paying for friends, you confirm each of them has a Pheaks account, has read this waiver, and agrees to it. 1. Voluntary participation You join this hike or tour of your own free will. You may turn back or sit out a segment if you are unwell or the ground is unsafe. A ticket does not guarantee that the itinerary will run exactly as posted. 2. Inherent risks Hiking and touring in the Philippines involve risks that cannot be removed, including: steep, loose, or wet terrain; river and boulder crossings; altitude; heat, rain, fog, lightning, landslides, and flash floods; fatigue, falls, sprains, cuts, and other injury; animals and insects; limited or delayed rescue; van, jeepney, or other vehicle travel on mountain roads; other participants; and changes or cancellation for weather, DENR or LGU orders, or trail closures. You accept those risks. 3. Fitness, age, and medical information You are responsible for being fit enough for the itinerary the Organizer published. You have disclosed medical conditions, blood type, and an emergency contact on your Tourism Manifest, and you will keep them true. The Organizer and their coordinators may use that information to run the trip and to help in an emergency. Pheaks does not decide whether you are fit to go. If you are under 18, a parent or legal guardian must agree to this waiver before you travel. Do not book a slot for a minor who has not consented through their guardian. 4. Instructions, equipment, and conduct You will follow the Organizer's briefing, the coordinators' instructions, Leave No Trace, and any DENR, LGU, or protected-area rules. You bring the gear the Organizer listed. You will not join under the influence of alcohol or illegal drugs. Reckless conduct, harassment, or putting the group at risk may get you removed from the trip without a refund of Pheaks' convenience fee. 5. Transport Hired vans and drivers are arranged by the Organizer, not by Pheaks. Seat belts where fitted, and the vehicle details on your ticket, are how you find your ride. Road accidents are a risk of the trip. 6. Photos and names The Organizer may take photos or video of the group for their page or for certificates. Tell them before the trip if you do not want to be featured. Your first name may appear in reviews the way Pheaks already shows them. 7. Emergency care If you are injured or ill, you authorize the Organizer and coordinators to arrange first aid or evacuation they reasonably think is needed. You (or your family) are responsible for medical, rescue, and evacuation costs. Personal accident insurance is strongly recommended. Pheaks does not insure you. 8. Release To the fullest extent Philippine law allows, you release and hold harmless the Organizer, their coordinators, drivers, and volunteers, and Pheaks and Jefferyl Castillo, from claims for injury, death, loss, or delay arising from the inherent risks of the activity or from ordinary negligence. This does not waive liability for willful misconduct or gross negligence where the law forbids that waiver. 9. Bookings and money Cancellation, forfeit, and the convenience fee follow Pheaks' Cancellations & refunds page. The Organizer runs the trail day. Disputes about cash or GCash paid outside Pheaks are between you and the Organizer. 10. Changes on the ground The Organizer may change the itinerary, turn around, or cancel for safety. Weather and local rules can stop a day. You follow the Organizer's call on the trail. 11. Governing law This waiver is governed by the laws of the Republic of the Philippines. If a court finds one part unenforceable, the rest still applies. The Organizer may replace this default with their own text. The version shown at checkout is the one you accept, and Pheaks stores that snapshot on your booking.
